Terms of Service
1. General Provisions
1.1. The Online Store is available at: as-planned.org (hereinafter referred to as the Online Store).
1.2. The owner of the Online Store is Elżbieta Olekszy, conducting unregistered business activity within the meaning of Article 5 of the Polish Entrepreneurs Law Act (hereinafter referred to as the Seller).
1.3. Contact with the Online Store is possible via email: help@as-planned.org
1.4. Through the Online Store, the Seller provides the Customer with the opportunity to conclude a contract for the delivery of digital content in the form of travel plans described on the Store pages.
1.5. Acceptance of these Terms of Service is voluntary, but necessary for full use of the Online Store.
1.6. Definitions
- Seller – Elżbieta Olekszy, conducting unregistered business activity, correspondence address: ul. Lubczykowa 53a, 62-064 Plewiska, Poland.
- Store – AS PLANNED online store operated by the Seller at as-planned.org
- Consumer/Buyer – a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- Product – digital content available in the Online Store in the form of travel plans containing detailed routes, locations, place descriptions, and tourist tips.
- Terms of Service – a document defining the principles of providing and using services made available by the Seller through the Store to Customers.
- Digital Content Delivery Agreement – a Sales Agreement for the delivery of digital content (travel plans).
2. Rules for Using the Online Store
2.1. Use of the Online Store may only take place on the terms and to the extent specified in these Terms of Service.
2.2. Use of the Online Store requires the Buyer to meet appropriate technical requirements:
- device with Internet access;
- standard operating system;
- web browser supporting JavaScript and cookies;
- active email address.
2.3. The Seller does not guarantee that connecting and browsing the website will be uninterrupted and free of technical defects.
2.4. The Seller reserves the right to suspend or restrict access to the Online Store at any time.
3. Purchases in the Store, Terms of Concluding and Withdrawing from the Agreement
3.1. Product prices visible on the website are given in Polish zloty (PLN) or euros (EUR) and are gross prices.
3.2. The price shown on the website at the time of placing the order is the final price binding on the Customer.
3.3. The purchasing process consists of the following stages:
- Selection of the desired travel plan
- Placing an order by clicking the purchase button
- Selection of payment method
- Payment execution through external payment system (Stripe)
- Purchase confirmation and receiving access to the plan
3.4. Orders in the store are placed by clicking the purchase button for the selected travel plan.
3.5. Delivery of ordered digital content takes place directly after the payment is recorded by the Seller.
3.6. Placing an order and confirming it through successful payment constitutes the conclusion of a Sales Agreement.
3.7. To receive a VAT invoice, you must correctly fill in the company data with the tax identification number (NIP/VAT ID).
3.8. The Store allows the purchase of digital content that is not recorded on a material medium. A Consumer who agrees to the commencement of such services before the expiry of the withdrawal period loses the right to withdraw from the Agreement in accordance with Article 38 point 13 of the Consumer Rights Act.
3.9. In exceptional situations where the right to withdraw would apply, a withdrawal form may be submitted with the formula: "I, [name, surname] hereby inform about my withdrawal from the sales contract for the following digital content [enter plan names]."
3.10. At the time of purchasing the Product, the Seller grants the Customer a non-exclusive, unlimited, non-transferable license for personal use.
3.11. Return Policy
3.11.1. Due to the nature of digital content delivered immediately after purchase, in accordance with Article 38 point 13 of the Consumer Rights Act, purchased travel plans are not subject to return.
3.11.2. The Consumer agrees to immediate delivery of digital content and thus expressly waives the right to withdraw from the contract.
3.11.3. If the travel plan does not match the description, contains errors, or there are technical problems, the Customer has the right to file a complaint in accordance with Section 6.
3.11.4. The lack of return possibility does not violate consumer rights arising from provisions regarding product non-compliance with the contract.
4. Forms of Payment for Order
4.1. The Seller provides the Buyer with electronic payments and card payments through the authorized external Stripe service.
4.2. Electronic and card payment transactions are processed through the Stripe platform.
4.3. The Store does not store payment card data - all payment data is processed directly by Stripe in accordance with the highest PCI DSS security standards.
5. Cost, Methods and Term of Product Delivery
5.1. The Seller does not impose territorial restrictions on delivery of digital content.
5.2. Delivery of digital content is free - no additional delivery charges.
5.3. Order fulfillment takes place by making the purchased plan available in the user's account directly after payment is posted.
5.4. At the moment the plan is made available in the user's account, the digital content is considered fully delivered.
6. Complaints
6.1. Any Product purchased in the Store can be complained about in case of:
- Product inconsistency with description
- Technical problems preventing access to the plan
- Errors in the travel plan content
- Other product defects
6.2. To file a complaint, inform the store via email at: help@as-planned.org, providing: order number or purchase date, name of the purchased plan, detailed description of the problem, expectations regarding the complaint.
6.3. The complaint will be processed no later than 14 days from the date of its submission.
6.4. If the complaint is upheld, the Seller may: fix errors, grant a discount on future purchases, or refund all or part of the payment.
6.5. Refund occurs no later than 14 days from the date of upholding the complaint.
7. Personal Data Protection
7.1. The controller of personal data is Elżbieta Olekszy conducting unregistered business activity.
7.2. Detailed information regarding the processing of personal data can be found in the Privacy Policy.
7.3. For the purpose of processing payments, data will be shared with the payment operator Stripe.

7.5. Personal data is processed for:
- Performance of concluded contracts (Art. 6(1)(b) GDPR)
- In other cases, on the basis of consent (Art. 6(1)(a) GDPR)
8. Intellectual Property Rights
8.1. All rights to the Online Store, in particular copyright and intellectual property rights, belong to the Seller.
8.2. Purchased travel plans are subject to copyright. The Customer acquires the right to personal use only, without the right to resale, public sharing, or commercial use.
8.3. It is forbidden to copy, duplicate, modify, or distribute any part of the Online Store or purchased plans for commercial purposes.
9. Final Provisions
9.1. The Terms of Service are available in Polish and English.
9.2. In matters not regulated by these Terms of Service, the provisions of generally applicable Polish law shall apply, in particular:
- Act of 30 May 2014 on consumer rights
- Act of 18 July 2002 on the provision of electronic services
- Regulation (EU) 2016/679 (GDPR)
- Civil Code
9.3. Unless mandatory provisions of law provide otherwise, the law applicable to resolving any disputes is Polish law.
9.4. The content of these Terms of Service may be changed. The Store will inform about any changes at least 14 days in advance.
9.5. Changes to the Terms of Service do not affect contracts concluded before the date the changes come into effect.
